1.1 – The terms and conditions of membership of Artists Resource shop should be read in conjunction with Artists Resource Privacy Policy – see below. 

1.2 – These terms and conditions are reviewed on a regular basis and Artists Resource reserves the right to amend them at any time, without notice.

1.3 – When you purchase any item from the shop you are automatically bound by these Terms and Conditions. Terms and Conditions are always available to view on your “My account” page.

1.4 – To purchase an Item from the shop, you must be over the age of 18. 

What customers receive as part of a purchase of an online class or online course

1.5  All customers receive: the class or course they have purchased plus free gifts of relaxting meditations and music. This is available for lifetime access, which means they can view all of their purchases, whenever they wish. Artists Resource reserves the right to remove or change any old classes or courses that will be updated, without notice. 

Account Acceptance and Termination

1.6 Artists Resource reserves the right to terminate an account, if it is deemed suspect (such as, but not limited to: someone will ill intent, malice, breaching the peace, online bullying), without explanation.

1.8 Artists Resource content is all videos and items in gifts section. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Site or Service Content or intellectual property, in whole or in part, without our prior written consent. This includes but is not limited to sharing material with others, posting excerpts of material on any social media, blogging about the material, or in any other way that would reasonably appear to share the Site or Service’s information with a non-member. We reserve the right to immediately remove you from the Service, without refund, if you are caught violating this intellectual property policy. Members are to not share content with any third party, under any circumstance, under the Copyright, Designs and Patents Act 1988.

1.9 Variation. No variation of purchase shall be effective.

2.0 Force majeure. Neither party shall be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations under these Terms and Conditions if such delay or failure result from events, circumstances or causes beyond its reasonable control.

2.1 Third parties. No one other than a party to these Terms and Conditions shall have any right to enforce any of its terms.

2.2  Governing law. These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales.

2.3 Jurisdiction. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions or its subject matter or formation.

2.4 LIMITATION OF LIABILITY

YOU AGREE THAT UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR ANY OTHER DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR SERVICE. Artists Resource IS NOT LIABLE FOR DAMAGES IN CONNECTION WITH (I) ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, DENIAL OF SERVICE, ATTACK, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, OR LINE OR SYSTEM FAILURE; (II) LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS, SAVINGS, GOODWILL OR DATA; AND (III) THIRD PARTY THEFT OF, DESTRUCTION OF, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF YOUR INFORMATION OR PROPERTY, REGARDLESS OF OUR NEGLIGENCE, GROSS NEGLIGENCE, FAILURE OF AN ESSENTIAL PURPOSE AND WHETHER SUCH LIABILITY ARISES IN NEGLIGENCE, CONTRACT, TORT, OR ANY OTHER THEORY OF LEGAL LIABILITY. THE FOREGOING APPLIES EVEN IF Artists Resource HAS BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN THE DAMAGES. IN NO EVENT SHALL Artists Resource’s CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL PURCHASE PRICE OF THE SERVICE YOU HAVE PURCHASED FROM Artists Resource .

PRIVACY POLICY

2.5  Artists Resource Shop  is protecting the rights and freedoms of data subjects and safely and securely processing their data in accordance with all of our legal obligations. This policy sets out the basis on which any personal data that you provide to us, will be processed by us In accordance with the Data Protection Act 1998. We take Privacy very seriously and do not take any more data than we need for the Shop to run its services.

2.6 We require very minimal data to be able to administer the shop that you are creating an account to.  Our lawful basis for processing your personal data is that we have a contractual obligation to you as a member to provide the services you are registering for.

2.7 The only information we collect is your address, email and password (in order for you to create an account and login) and information that you give to us within emails. We do not and would not even consider sharing this information with any third parties. We do not hold any information such as Debit/Credit card info as this is administered by Stripe. 

2.8 The Artists Resource Website uses Google Analytics for the purposes of analyzing website traffic and does not collect your data, or attempt to identify you or any members in any way.
